Careful, here! Remember how the GLRL advocated for social security ‘equality’ (as distinct from equity), which ended up with heaps of gay and lesbian couples becoming worse off, financially? Someone forgot to include a sunset clause. Ditto, with calls to remove the provocation defence from the NSW Crimes Act. While that might make the odious R v Green decision obsolete, it will also mean that those cases where provocation should remain reasonable justification for reducing a murder sentence to manslaughter, will no longer be possible. I think here of women who finally ‘fight back’ against their abusive male partners.
