That hasn’t changed. Giggle was twice found to have discriminated against Ms Tickle; indirectly at fist Instance and directly on appeal under the “gender identity” attribute. The FCAFC followed a line of precedents since 1993 holding Ms Tickle to be female under federal law just as she is also regarded under relevant State law.
